1. WHAT IS THE PURPOSE OF THIS DOCUMENT?

Please read carefully this document, which sets forth the General Terms and Conditions (hereinafter, “The “Conditions”) for the use of this web platform and for making ONLINE PURCHASES of any of our products available in our catalog, as well as the documents related to the Cookie Policy and the Data Protection Law. By making or executing any PURCHASE process, you tacitly ACCEPT all the Conditions that govern the operation of our platform associated with the domain www.miguelbarros-artworks.com.

2. WHO ARE WE?
The sale of DIGITAL ART through this website is carried out under the trade name MIGUEL BARROS ARTWORKS. The legal representative for all purposes and owner of the copyright and all exploitation rights belongs to the company “ARKHAL DESARROLLO DE NEGOCIO SL,” whose details appear in the Legal Notice and which can be contacted at the following email address: info@miguelbarros-artworks.com

3. AGE AND CAPACITY
By placing an order through this website, you declare that you are of legal age and have sufficient legal capacity to make any online purchase. Generally, minors must always obtain prior consent from their parents, guardians, or legal representatives, who are ultimately responsible for all actions taken by the minors under their care.

4. WHICH COUNTRIES DO WE SHIP TO?
The items offered through this website are available for shipment to countries where their sale is authorized.

5. WHAT STEPS DO YOU NEED TO FOLLOW TO COMPLETE YOUR PURCHASE?
ONLINE STEPS
To place an order, you must follow the online purchase procedure and click on "PAY" or the equivalent button. After this, you will receive an email acknowledging receipt of your order (the "Order Confirmation"), and you can proceed (via a link) to the actual PURCHASE of any of our ORIGINAL PRINTED and FRAMED ARTWORKS. The order will then be processed with the commitment to deliver it to the address you have provided within the timeframes established in the DELIVERY section.

PRICE AND PAYMENT
The prices on the website do not include VAT, which will be charged on the invoice when applicable according to current legislation. Shipping costs will be added to the total amount at a fixed rate based on geographic zones. If any condition is met (for example, due to purchase volume or a promotion) that qualifies for free shipping, this will be indicated and displayed as zero cost. Purchases of our ARTWORKS from countries outside the European Union (EU) are subject to customs duties (they are considered IMPORTS of ARTWORKS), and these duties vary depending on the country. Customs obligations are always the responsibility of the BUYER.

Prices may change at any time, but any changes will not affect orders for which we have already sent an Order Confirmation. Once you have selected all the items you wish to purchase, they will be added to your cart, and the next step will be to process the order and make the payment. To do this, you must follow the steps in the purchase process, filling in or verifying the information requested at each step. You can also modify your order details during the purchase process before making the payment.

Prices may change at any time, but any changes will not affect orders for which we have already sent an Order Confirmation. You can use the following PAYMENT METHODS:

Credit cards are subject to verification and authorization by the issuing bank. If the bank does not authorize the payment, we will not assume any responsibility.

DELIVERY
Once the PURCHASE is made, the DELIVERY of the original artwork (FRAMED OR UNFRAMED) printed in high quality (FINE ART) will be immediate. Orders will be processed in a timely manner according to the destinations as follows:

European Union countries: 2 to 5 business days; other European countries: 5 to 7 business days; USA, Canada, and Mexico: 5 to 8 business days; for Spanish-speaking countries in Central and South America (Chile, Peru, Colombia, Uruguay, Argentina, Paraguay, Bolivia, Ecuador, Costa Rica, Panama, and Brazil): 7 to 10 business days. For Asian and Oceanian countries: 7 to 15 business days, depending on the country. We will also inform you of the order status via email with a "Shipping Confirmation."

If for any reason we are unable to meet the delivery date, we will inform you and give you the option of setting a new delivery date or canceling the order with a full refund.

For the purposes of these Terms and Conditions, "delivery" or "delivered" shall be understood to have occurred when YOU, or an authorized third party, takes physical possession of the Printed and Framed Originals (if you so choose), which will be evidenced by a signature upon receipt of the order at the agreed delivery address.

6. IN WHAT LANGUAGES CAN THE PURCHASE BE MADE?
Purchases can be made in both Spanish and English.

7. PRODUCT AVAILABILITY
All orders are subject to the availability of the printed originals. If there are any difficulties in supplying these originals or if items are out of stock, we will refund any amount that may have been paid.

8. RETURNS POLICY
IMPORTANT INFORMATION REGARDING THE RIGHT OF WITHDRAWAL
Please note that you will NOT have the RIGHT to withdraw from the PURCHASE contract for PRINTED ORIGINALS signed with us, as the SPECIFIC PURPOSE of the contract is the SUPPLY of ORIGINALS, which have been specially printed and are therefore CUSTOMIZED ITEMS with their Explicit Warranty Certification.

RETURNS OF DEFECTIVE PRODUCTS
If you believe that the product delivered does not conform to the contract, you must contact us immediately through our contact channels, providing details of the product and the damage it has sustained. We will then advise you on the procedure. You can return the product directly to our address using a courier service that we will specify. We will carefully examine the returned product and notify you by email within a reasonable timeframe whether a refund or replacement is applicable. The refund or replacement will be processed as soon as possible and, in any case, within 15 days of the date of the EMAIL CONFIRMING that a refund or replacement of the non-conforming item is due.

9. LIABILITY AND LIMITATION OF LIABILITY
Unless expressly stated otherwise in these Terms and Conditions, our liability in relation to any product purchased on our website is strictly limited to the purchase price of that product. However, and unless otherwise required by law, we will not accept any liability for the following losses, regardless of their origin: i. loss of income or sales; ii. loss of business; iii. loss of profits or contracts; iv. loss of anticipated savings; v. loss of data; and vi. loss of management time or office hours.

Due to the open nature of this website and the possibility of errors occurring in the storage and transmission of digital information, we do not guarantee the accuracy and security of information transmitted or obtained through this website unless expressly stated otherwise herein.

10. REGARDING EVENTS BEYOND OUR CONTROL
We will not be liable for any failure or delay in performing any of our obligations when such failure or delay is due to events beyond our reasonable control ("Force Majeure Event"). Force Majeure Events include any act, event, non-occurrence, omission, or accident beyond our reasonable control, including but not limited to the following: a. Strikes, lockouts, or other industrial action. b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war. c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster. d. Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transportation. e. Impossibility of the use of public or private telecommunications systems. f. Acts, decrees, legislation, regulations, or restrictions of any government or public authority. Our obligations will be suspended for the duration of the Force Majeure Event, and we will be granted an extension of time to perform these obligations for a period equal to the duration of the Force Majeure Event. We will use all reasonable endeavors to bring the Force Majeure Event to an end or to find a solution that allows us to fulfill our obligations.

11. PARTIAL INVALIDITY
If any of these Terms and Conditions or any provision of a contract is declared null and void by a final ruling issued by a competent authority, the remaining terms and conditions will remain in full force and effect, unaffected by said declaration of nullity.

12. OUR RIGHT TO MODIFY THESE TERMS AND CONDITIONS
We reserve the right to modify these terms and conditions. Modifications will not be retroactive and, except for possible exceptions depending on the specific case, will apply 30 days after the date of their publication in the corresponding section. If you do not agree with the modifications, we recommend that you do not use our website.

13. APPLICABLE LAW AND JURISDICTION
The use of our website and contracts for the purchase of products through it will be governed by Spanish and EU law. Any dispute arising from or related to the use of this website or these contracts shall be subject to the non-exclusive jurisdiction of the courts of Vigo, Spain.

If you are contracting as a consumer, the provisions of the preceding paragraph shall not affect the protection afforded to you as a consumer under any provisions that cannot be excluded by agreement under the laws of your country.

Your comments and suggestions are welcome. Please send them to us, as well as any inquiries, complaints, or claims, through our contact channels or to the postal or email address indicated in clause 2 of these Terms and Conditions.

In addition, official complaint forms are available for consumers and users. You may request them through our contact channels. Your complaints and claims to our customer service department will be addressed as soon as possible and, in any case, within the legally established timeframe.
